(Published in The Courier-Tribune Wednesday, September 1, 2010) ORDINANCE NO. 081010 AN ORDINANCE VACATING AN ALLEY LOCATED IN BLOCK 16, ORIGINAL TOWN OF BERN, KANSAS, WHICH ALLEY IS ADJACENT TO LOTS 1, 2, 3, 4, 5, 6, 7, 8, 9, 10, 11, AND AN ALLEY ADJACENT TO LOTS 11, 12, 13, 14, AND 15, IN SAID BLOCK 16 ORIGINAL TOWN OF BERN, KANSAS, AND A PORTION OF TAYLOR STREET BETWEEN ESSIE STREET AND MAIN STREET, AND THE EAST 38.5 FEET OF THE ALLEY IN BLOCK 4; AND THE EAST 38.5 FEET OF THE ALLEY IN BLOCK 17, ORIGINAL TOWN OF BERN, NEMAHA COUNTY, KANSAS. WHEREAS, the Governing Body of the City of Bern, Nemaha County, Kansas, has received a Petition from a majority of all of the resident owners of the real estate adjoining the street described below requesting the vacation of said street pursuant to the provisions of K.S.A. 12-504; and, WHEREAS, the Governing Body published notice of hearing on said petition pursuant to K.S.A. 12-504 and conducted a hearing on May 19, 2008, at 7:00 o’clock p.m. regarding the request to vacate said street; and, WHEREAS, after hearing all interested parties at such time, the Governing Body has determined that it is in the best interests of the City of Bern to vacate said street; and, NOW THEREFORE, BE IT ORDAINED by the Governing Body of the City of Bern, Nemaha County, Kansas: Section 1. That that portion of the Taylor Street and the vacated railroad right-of-way located in the Original Town of Bern, Nemaha County, Kansas, being more particularly described as follows: Beginning at the Northwest Corner of Block 4, Original Town of Bern, thence Southerly along the West line of Blocks 4 and 17, Original Town of Bern a distance of 480 feet to the Southwest Corner of said Block 17; Thence West 60 feet to the Southeast Corner of Block 16, Original Town of Bern; Thence Northerly along the East line of Block 16 and Block 15 a distance of 480 feet to the Northeast Corner of Block 15, Original Town of Bern; Thence East 60 feet to the Point of Beginning, containing 0.66 acres; AND the alley located in Block 16, Original Town of Bern, Nemaha County, Kansas, which alley is adjacent to Lots 1, 2, 3, 4, 5, 6, 7, 8, 9, and 10, and the alley which is adjacent to Lots 11, 12, 13, 14, and 15, all in Block 16, Original Town of Bern, Nemaha County, Kansas; AND the East 38.5 feet of the alley in Block 4, Original Town of Bern, Nemaha County, Kansas; AND the East 38.5 feet of the alley in Block 17, Original Town of Bern, Nemaha County, Kansas, is hereby vacated. Section 2. That the land in said street and alleys so vacated shall revert to the owners of the land thereto adjacent on either side, being Lot 10- in Block 16, Lot 18 in Block 15, Lot 1 in Block 4, and Lot 1 in Block 17, all in the Original Town of Bern, Nemaha County, Kansas, subject to an easement and right of way in favor of the City of Bern and public utilities for existing utilities and such other public services as the governing body deems necessary. Section 3. That this ordinance shall become effective after publication once in the official public newspaper and the City Clerk shall immediately file a certified copy in the office of the Register of Deeds of Nemaha County, Kansas.
